Alan Dial Helps Man Avoid Capital Sentence
 

 

It is rare indeed in a lawyer’s career when an opportunity arises to save the life of another. Our friend, Alan Dial of King & Spalding, several of his colleagues at the firm, and attorneys and law students from the University of Virginia’s Innocence Project and the Virginia Capital Representation Resources Center, achieved a remarkable victory in the pro bono representation of Virginia death-row inmate Justin Wolfe.  Judge Raymond Jackson (E.D. Va.) entered a memorandum opinion and order (see attachment) granting Wolfe's petition for habeas relief and vacating Wolfe's 2002 murder-for-hire conviction and capital sentence, on the grounds that the Commonwealth of Virginia prosecutors had denied Wolfe his due process rights by failing to apprise him of all material, exculpatory information as required under Brady v. Maryland, and used false testimony against him in violation of Giglio v. United States and Stockton v.
