Joseph Drayton of Kaye Scholer Wins Patent Infringment Defense Verdict

Joseph M. Drayton of Kaye Scholer LLP recently won a major victory in the United States District Court for the Eastern District of Texas in a patent litigation matter. Attorney Drayton's firm defended Pier 1 Imports and Stored Value Solutions ("SVS"), a prepaid card processing company in a matter brought by Alexsam, a non-practicing entity (patent troll). Attorney Drayton played a key role in the win for Pier 1 and SVS by  examining most of the trial witnesses, including cross-examining both the technical and financial experts. Attorney Drayton also presented the closing argument in the case. The Plaintiffs’ in the case sought  $26 million in past damages, and an additional $12 million in future damages. The heart of Plaintiff's infringment claim focused on the SVS business systems, which are used by Pier 1 and hundreds of other clients. Litigating the case to trial was the first line of defense for SVS, which proved to be a huge success with the help of Attorney Drayton and the Kay Scholer trial team.
